Terms of Service for Ishur

1. Agreement to Terms
By accessing or using Ishur ("Service," "Application," or "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service
Ishur is a web and mobile application that enables users to create payment receipts and confirmations (קבלה/אישור) for their business or personal use. The Service is designed for Israeli small businesses, freelancers, and individuals.
Important Note: Ishur generates payment receipts and confirmations only. It does NOT generate tax invoices (חשבונית מס). Tax invoices require proper licensing and registration with Israeli tax authorities. Users requiring tax invoices should consult with a licensed accountant.
3. Eligibility
You must be at least 18 years old to use this Service. By using Ishur, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- You will use the Service in compliance with all applicable Israeli laws
4. Account Registration
4.1 Account Creation
- You must register using a valid Google account
- You are responsible for maintaining the security of your account
- You must provide accurate and complete information
- You are responsible for all activities that occur under your account
4.2 Account Security
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
- You are liable for any unauthorized use of your account
4.3 Account Termination
You may terminate your account at any time by contacting us at contact@ishur.app. We may suspend or terminate your account if you violate these Terms.
5. Subscription Plans and Pricing
5.1 Available Plans
Free Plan:
- Limited features
- Limited number of receipts per month
- Access to basic receipt templates
Monthly Subscription:
- Price: ₪10 per month
- Full access to all features
- Unlimited receipt generation
- All receipt templates
Yearly Subscription:
- Price: ₪90 per year (equivalent to ₪7.50/month)
- Full access to all features
- Unlimited receipt generation
- All receipt templates
- 25% savings compared to monthly plan
5.2 Payment Terms
- All payments are processed through Paddle, our payment processor
- Subscriptions automatically renew unless cancelled
- Prices are in Israeli New Shekels (₪) and include VAT where applicable
- We reserve the right to change pricing with 30 days' notice to existing subscribers
5.3 Currency and Taxes
- All prices are listed in Israeli New Shekels (₪)
- VAT will be added as required by Israeli law
- Paddle, as Merchant of Record, handles all tax collection and remittance
6. Billing and Automatic Renewal
6.1 Automatic Renewal
- Subscriptions automatically renew at the end of each billing period
- Your payment method will be charged automatically
- You will receive email notification before each renewal
6.2 Cancellation
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- You will retain access to paid features until the end of the billing period
- To cancel, visit your account settings or contact contact@ishur.app
6.3 Failed Payments
If a payment fails, we will:
- Attempt to process the payment again
- Notify you via email
- Suspend your access to paid features if payment is not resolved within 7 days
7. Refund Policy
7.1 Right to Cancel
You have the right to cancel your subscription and request a refund within 14 days of your purchase without giving any reason.
7.2 Refund Requests
To request a refund:
- Contact us at contact@ishur.app or contact Paddle (our payment processor) directly
- Include your order number and account email
- Refunds will be processed to your original payment method within 5-10 business days
7.3 Refund Processing
All payments are processed through Paddle, our Merchant of Record. Paddle handles all refund requests on a case-by-case basis. This does not affect your rights as a consumer in relation to services which are not as described, faulty, or not fit for purpose.
7.4 Exceptional Circumstances
Refunds may be considered in exceptional circumstances such as:
- Service outages
- Billing errors
- Technical issues that prevent service use
8. Acceptable Use Policy
8.1 Permitted Use
You may use Ishur to:
- Generate payment receipts for legitimate business or personal transactions
- Store and manage your receipt records
- Download or print receipts for your records
8.2 Prohibited Use
You may NOT use Ishur to:
- Create fraudulent or false receipts
- Generate receipts for illegal transactions
- Misrepresent transactions or amounts
- Violate any Israeli tax laws or regulations
- Attempt to generate tax invoices (חשבונית מס) without proper authorization
- Resell or redistribute the Service
- Reverse engineer, decompile, or disassemble the Service
- Use automated means to access the Service (bots, scrapers, etc.)
- Share your account with others
- Violate any applicable laws or regulations
8.3 Consequences of Violation
Violation of these terms may result in:
- Immediate account suspension or termination
- Forfeiture of any prepaid fees
- Legal action if necessary
9. Intellectual Property Rights
9.1 Service Ownership
Ishur and all related intellectual property (including software, design, logos, and content) are owned by us or our licensors. These Terms do not grant you any ownership rights.
9.2 Your Content
You retain ownership of all receipts and data you create using Ishur. By using the Service, you grant us a limited license to:
- Store and process your data
- Display your data back to you
- Make backups for service reliability
9.3 License to Use Service
We grant you a limited, non-exclusive, non-transferable license to use Ishur for your personal or business purposes in accordance with these Terms.
10. Your Data and Privacy
10.1 Data Ownership
You own all data you create in Ishur, including:
- Receipt content
- Customer information
- Business details
10.2 Data Access
You can export or delete your data at any time through your account settings.
10.3 Data Deletion
Upon account termination:
- We will delete your personal data within 30 days
- Some data may be retained longer as required by Israeli law
- Receipts and content will be permanently deleted

11. Service Availability and Support
11.1 Service Availability
- We strive for 99% uptime but cannot guarantee uninterrupted access
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions
11.2 Customer Support
- Support is provided via email at contact@ishur.app
- We aim to respond within 48 hours during business days
- Support is provided in Hebrew and English
11.3 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any feature
- Update the Service to comply with legal requirements
- We will provide reasonable notice for material changes
12. Disclaimers and Limitations of Liability
12.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness
12.2 No Legal or Tax Advice
Ishur does NOT provide legal, tax, or accounting advice. You are responsible for:
- Ensuring your use complies with Israeli tax laws
- Determining whether receipts or tax invoices are required for your transactions
- Consulting with licensed professionals for tax and legal matters
12.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY ISRAELI LAW:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the past 12 months
- We are not responsible for any loss of data, profits, or business opportunities
12.4 User Responsibility
You are solely responsible for:
- The accuracy of information in your receipts
- Compliance with Israeli tax and business regulations
- Proper record-keeping as required by law
- Determining whether you need tax invoices instead of receipts
13. Compliance with Israeli Law
13.1 Tax Invoices vs. Receipts
Ishur generates payment receipts (קבלה) and confirmations (אישור), NOT tax invoices (חשבונית מס). Tax invoices require:
- Registration as an authorized dealer (עוסק מורשה)
- Proper licensing from Israeli tax authorities
- VAT registration and reporting
Users requiring tax invoices must obtain proper licensing or use licensed accounting software.
13.2 Governing Law
These Terms are governed by the laws of the State of Israel. Any disputes will be resolved in the competent courts of Israel.
13.3 VAT and Taxes
- VAT will be charged as required by Israeli law
- Paddle, as Merchant of Record, handles VAT collection and remittance
- You are responsible for any additional tax obligations related to your use of receipts
14. Indemnification
You agree to indemnify and hold harmless Ishur, its owners, employees, and partners from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any laws or regulations
- Your creation of fraudulent or false receipts
- Any disputes with your customers or business partners
15. Dispute Resolution
15.1 Informal Resolution
Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at contact@ishur.app.
15.2 Jurisdiction
Any legal disputes will be subject to the exclusive jurisdiction of the courts in Rishon LeZion, Israel.
15.3 Language
Both English and Hebrew versions of these Terms are equally valid. In case of any discrepancies, the version corresponding to your account's language setting will apply.
16. Changes to Terms
16.1 Modification Rights
We reserve the right to modify these Terms at any time. Changes will be effective:
- Immediately upon posting for new users
- 30 days after notification for existing users
16.2 Notification of Changes
We will notify you of material changes via:
- Email to your registered address
- Prominent notice in the Application
- Update to the "Last Updated" date at the top of this document
16.3 Acceptance of Changes
Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to changes, you must stop using the Service and may request account deletion.
17. Termination
17.1 Termination by You
You may terminate your account at any time by:
- Contacting us at contact@ishur.app
- Using the account deletion feature in your settings
17.2 Termination by Us
We may terminate or suspend your account immediately if:
- You violate these Terms
- You engage in fraudulent activity
- You fail to pay applicable fees
- We are required to do so by law
- We discontinue the Service
17.3 Effect of Termination
Upon termination:
- Your access to the Service will cease immediately
- You will no longer be charged for subscription fees
- Your data will be deleted according to our Privacy Policy
- No refunds will be provided for prepaid periods (except as provided in our refund policy)
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ishur regarding the Service.
18.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
18.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
18.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms to any successor or affiliate.
18.5 Force Majeure
We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet service disruptions.
18.6 Language
Both English and Hebrew versions of these Terms are equally valid. In case of any discrepancies, the version corresponding to your account's language setting will apply.
